Good Morning Berlin, represented by Elodie Benchereau, offers guided tours and activities in Berlin. The following Terms & Conditions govern the contractual relationship between Elodie Benchereau and her clients and users.
By making a payment for a guided tour or activity with Good Morning Berlin, you confirm that you have read and accepted the following Terms & Conditions.
Conclusion of the Contract
The contract between Good Morning Berlin, represented by Elodie Benchereau, and the client becomes effective under the following conditions:
Written acceptance by the client of a quotation sent by Elodie Benchereau.
Payment of all or part of the service by the client.
By making a booking and entering into the contract, the client accepts the following Terms & Conditions.
The client makes a booking either for themselves or on behalf of a group they represent. The client must be of legal age and accepts responsibility for the group, where applicable.
Booking and Payment Terms
The booking is only confirmed once full payment for the tour has been received.
Good Morning Berlin confirms the booking, including the date and time of the guided tour, by email or telephone.
Guided tours take place regardless of weather conditions, provided that the safety of participants is not compromised. Bicycle tours may, for example, be replaced by a walking tour if weather conditions are unsuitable for cycling.
Participants must arrive on time. If a participant is more than 15 minutes late, their participation may be cancelled and no refund will be provided.
Guided tours start at the meeting point indicated in the booking confirmation email.
The participant pays the agreed price in advance by bank transfer, by credit card via the online payment systems provided, or in cash at the time of the guided tour.
Cancellation and Changes
Cancellation and change requests must be sent by email to elodie@goodmorningberlin.com.
Good Morning Berlin will make every effort to accommodate requests for changes, but cannot guarantee the availability of the guide if the client wishes to change the date or time of the tour.
Adding participants may result in additional charges. No discount will be granted if the number of participants is lower than originally agreed.
If we are unable to accommodate a requested change, the client may choose either to keep the tour under the originally agreed conditions or to cancel the tour.
Unless otherwise specified when the contract is concluded, the following cancellation terms apply to private tours:
For cancellations made more than 14 days before the tour date, a 15% administration fee will be retained.
For cancellations made between 14 days and 72 hours before the tour date, 50% of the total amount will be retained.
For cancellations made less than 72 hours before the tour, no refund will be provided.
Private Cruises
The following cancellation terms apply to private cruises:
For cancellations made more than 28 days before the cruise date, a 15% administration fee will be retained.
For cancellations made between 28 and 14 days before the cruise date, 50% of the total amount will be retained.
For cancellations made between 13 days and 48 hours before the cruise, 75% of the total amount will be retained.
No refund will be provided for cancellations made less than 48 hours before the scheduled cruise departure time.
Purchases of e-books are non-refundable.
The cancellation and change terms applicable to services provided by third parties will be specified in the quotation.
Tour Programme
The content of the tours is described on our website or agreed upon by email.
Routes and tour content may vary in the event of construction works, strikes, demonstrations, unusual weather conditions or force majeure.
The guide adapts the tour to the pace of the participants and may modify the itinerary or shorten the tour if participants wish to take a break, spend additional time at one of the stops or arrive late for the tour.
Such changes and adaptations to the itinerary do not give rise to any right to a refund or financial compensation.

Safety
Clients participate in tours at their own risk.
Participants must comply with traffic regulations at all times.
Good Morning Berlin and the guides conducting the tours are not responsible for injuries or damage caused by the deliberate or negligent behaviour of participants.
We cannot be held responsible for any injuries occurring before, during or after the tour.
Participants are responsible for determining whether they are physically able to participate safely in the guided tour.
Participation is at the participant’s own risk.
Good Morning Berlin does not provide insurance coverage for participants.
Limitation of Liability
Good Morning Berlin is responsible for ensuring that booked tours are carried out to the best possible standard, for the careful selection and supervision of its partners and service providers, for the accuracy of the service specifications and for arranging the agreed services.
Good Morning Berlin accepts no liability for services offered as external services by third parties.
Good Morning Berlin and the guides conducting the tours are not responsible for damage caused by the malfunction of rental bicycles or private bicycles used during the guided tour.
Participants must check that their bicycles are in proper working order before the tour begins.
Cancellation by Good Morning Berlin
Good Morning Berlin reserves the right to cancel the contract in the following circumstances:
If the tour has to be cancelled due to illness or the guide’s failure to attend. The client will receive a full refund.
If the tour is cancelled due to force majeure. The client will receive a full refund.
If the safety of participants cannot be guaranteed. The client will receive a full refund.
Exclusion of Participants
Good Morning Berlin and the guides conducting the tours reserve the right to refuse participation or exclude participants whose behaviour disrupts the proper conduct of the tour or endangers other participants.
In the event of exclusion, the excluded participant will not be entitled to a refund, and additional compensation or damage-related charges may apply.
Jurisdiction
All agreements between the client and Good Morning Berlin are governed by the laws of the Federal Republic of Germany.
The place of jurisdiction and performance is Berlin.
Should any individual provision of these Terms & Conditions be legally invalid, this shall not affect the validity of the remaining provisions.
